1. About these terms

These terms of service ("Terms") govern your use of the Deduct AU website and service at deductau.com ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. About Deduct AU

Deduct AU (ABN 30 454 172 063) is a sole trader business based in Australia. The Service provides an AI-powered tool that analyses work-related expenses against publicly available Australian Taxation Office (ATO) guidelines.

3. Nature of the service

Deduct AU provides general information only. It is not financial advice, taxation advice, or legal advice.

  • Deduct AU is not a registered tax agent, financial adviser, or legal practitioner.
  • The analysis is generated by artificial intelligence based on publicly available ATO guidelines for FY2025–26. It does not account for your full financial circumstances.
  • The analysis does not guarantee that any expense is deductible. Individual circumstances vary and may affect your entitlements.
  • You should consult a registered tax agent or the ATO directly for personalised advice before making decisions based on the analysis.

4. Eligibility and acceptable use

To use the Service, you must be at least 18 years of age. By using the Service, you agree to:

  • Provide accurate and truthful information about your occupation, employment type, and expenses.
  • Use the Service only for its intended purpose — analysing your own work-related expenses.
  • Not attempt to manipulate, reverse engineer, or interfere with the Service, including attempting to inject instructions into the AI analysis.
  • Not use automated systems (bots, scrapers, or similar tools) to access the Service without our prior written consent.
  • Not use the Service for any unlawful purpose or in violation of any applicable Australian law.

5. Payment and pricing

  • The full report, including all expenses and a downloadable PDF, requires a one-off payment of $14.90 AUD (inclusive of GST, if applicable).
  • Payment is processed securely by Stripe. We do not receive or store your credit card details.
  • There is no subscription. Each payment unlocks a single analysis report.
  • Pricing may change for future analyses. Any price change will not affect analyses you have already paid for.

6. Refunds

Because the full report is a digital product delivered instantly upon payment, we do not offer change-of-mind refunds.

If the Service fails to deliver your report due to a technical error (for example, the analysis could not be generated or the report page did not load), please contact us at contact@deductau.com with your payment details and a description of the issue. We will investigate and, where the Service has failed to perform, issue a full refund.

Your consumer rights

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel and receive a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

7. Intellectual property

  • Your data: You retain ownership of all expense data and information you enter into the Service. We do not claim any rights over your input data.
  • Your report: The analysis report generated for you is for your personal use. You may share it with your tax agent or accountant. You may not resell, publish, or redistribute reports commercially.
  • The Service: All other content, design, code, and intellectual property of Deduct AU remain the property of Deduct AU. You may not copy, modify, or create derivative works from the Service without prior written consent.

8. Accuracy and disclaimers

  • The analysis is generated by AI and is based on publicly available ATO guidelines current at the time of analysis (FY2025–26). ATO rules may change, and the analysis may not reflect the most recent updates.
  • The analysis is general in nature and does not take into account your complete financial situation, other income sources, investments, or personal circumstances.
  • Deduct AU does not guarantee the accuracy, completeness, or reliability of any analysis. Errors in AI-generated content are possible.
  • You are solely responsible for any decisions you make based on the analysis, including claims made on your tax return.
  • We strongly recommend reviewing the analysis with a registered tax agent before relying on it.

9. Limitation of liability

To the maximum extent permitted by law, and subject to Section 6 (Your consumer rights under the Australian Consumer Law):

  • Deduct AU's total liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid for the analysis (currently $14.90 AUD).
  • Deduct AU is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue, financial penalties, ATO assessments or audits, or any other loss arising from decisions based on the analysis.
  • Deduct AU is not liable for any loss or damage resulting from circumstances beyond our reasonable control, including failures of third-party services (Stripe, Azure OpenAI, Cloudflare).

Nothing in these Terms attempts to exclude liability that cannot be excluded under Australian law, including the Australian Consumer Law.

10. Service availability

We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss caused by the Service being temporarily unavailable.

11. Accounts (optional)

You can use the Service without creating an account. An account is only required if you want to save your analysis reports and revisit them later.

  • Passwordless sign-in: Accounts use a 6-digit one-time code sent to your email, or Google sign-in. There are no passwords to manage or reset.
  • Matching email: To save a paid report to an account, the email you sign in with must match the email used at checkout.
  • Your responsibility: You are responsible for keeping access to the email address or Google account you sign in with. Anyone with access to your email can request a sign-in code.
  • Retention: Reports linked to your account are retained while your account is active. Reports generated without signing in are retained for 30 days only.
  • Account deletion: You can request deletion of your account and associated reports at any time by emailing contact@deductau.com.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be posted on this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Australia. Any dispute arising under these Terms is subject to the non-exclusive jurisdiction of the courts of Australia.
